WSC Adult Top Team Fall Season (You are only eligible to sign up if you have been offered a spot!)

I acknowledge that soccer or any sporting event is an extreme test of a person's physical and mental limits and that my participation in a sports event can cause serious injury, property damage, or even death. There are certain inherent risks associated with participating in sports, either as an athlete or spectator, which cannot be eliminated. These risks include, but are certainly not limited to: (1) minor injuries such as scratches, cuts, bruises, and strains; and (2) major injuries such as injuries to the eyes, infection, contracting a virus or disease, including COVID-19, loss of sight, joint injuries, back injuries, heart attacks, concussions, paralysis, and even death. Please contact the Centers for Disease Control (the CDC), your state and/or local governments for the most up-to-date information and guidance as it relates to COVID-19 and other health concerns. With a full understanding of the potential risks, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN ARISING FROM THE NEGLIGENCE OF THE NAMED PERSONS OR ENTITIES listed or others, and assume full responsibility for the listed player participation. I hereby take the following action for the listed player, myself, my executors, administrators, heirs next of kin, successors, and assigns: I WAIVE, RELEASE, AND DISCHARGE from any and all claims or liabilities for death or personal injury or damages of any kind which arise out of or relate to traveling to and from or participation in any sports practice, tournament, game, or event involving Windermere Soccer Club and Sunlight Football Club. I AGREE NOT TO SUE any of the named persons or entities listed herein for any of the claims or liabilities that I, the player listed, have waived, released, or discharged herein. I INDEMNIFY AND HOLD HARMLESS the named persons or entities listed here for any of the claims made or liabilities assessed against them as a result of my actions or listed player actions. NAMED PERSONS OR ENTITIES: Tellavised INC DBA Sunlight Football Club, Windermere Soccer Club, its owners, directors, managers, coaches, assistant coaches, chaperones, any venue where we practice or play, any tournament directors, sponsors, and the owners, officers, directors, employees, subcontractors, representatives, and agents of any of the above entities. By signing this waiver, I acknowledge that even if Windermere Soccer Club and/or Sunlight Football Club and/or any of their affiliates, directors, officers, officials, employees, agents, or volunteers use reasonable care in providing this activity, there is a chance I or the listed player may be seriously injured or killed by participating in this activity because there are certain dangers inherent in the activity which cannot be avoided or eliminated. By signing this waiver, I am giving up my right and the right of the listed player to recover from Windermere Soccer Club and/or Sunlight Football Club, and/or any of their affiliates, directors, officers, officials, employees, agents, or volunteers in a lawsuit for any personal injury, including death, to myself or any property damage that results from the risks that are a natural part of the activity or due illness including COVID-19. I hereby bind myself and all other assignees to the terms of this waiver. I represent that I have the legal capacity and authority to act for and on behalf of myself, and I agree to indemnify and hold harmless the named persons or entities named in.

I hereby grant permission to Sunlight Football Club and Windermere Soccer Club to photograph and/or record videos of my image, likeness, or depiction. By clicking the checkbox or providing electronic consent, I hereby grant permission to Sunlight Football Club and Windermere Soccer Club to edit, crop, or retouch such photographs or videos, and waive any right to inspect the final photographs or videos. I hereby consent to and permit photographs and/or videos of myself to be used by Sunlight Football Club and Windermere Soccer Club worldwide for any purpose, including educational and advertisement purposes, and in any medium, including print and electronic, and social media. I understand and agree that Sunlight Football Club and Windermere Soccer Club may use such photographs and/or videos with or without associating names thereto. I further waive any claim for compensation of any kind for Sunlight Football Club and Windermere Soccer Club’s use or publication of photographs and/or videos of myself. I hereby fully and forever discharge and release Sunlight Football Club, Windermere Soccer Club and their affiliates, officers or members from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness or image) arising out of the use or publication of photographs or videos of myself by Sunlight Football Club and Windermere Soccer Club and covenant and agree not to sue or otherwise initiate legal proceedings against Sunlight Football Club and Windermere Soccer Club for such use or publication. All grants of permission and consent, and all covenants, agreements, and understandings contained herein are irrevocable. I acknowledge and represent that I am over the age of 18, have read this entire document, that I understand and agree to its terms and provisions, and that I have clicked the checkbox or provided electronic consent.

I understand and agree that once this Financial Agreement is signed, I am committed to Windermere Soccer Club and Sunlight Football Club for the upcoming season. I understand and agree that if, for any reason, I decide to leave the season before its end, an early termination fee of US$100 will be added to the final amount due. I understand and agree that all payments made under this Agreement will be irrevocable, non-refundable, and non-creditable. This contract CANNOT BE TERMINATED even in the event of injury, mental health, family relocation, dismissal from the program, or any other reason not described here. I understand and agree that money paid to Windermere Soccer Club and Sunlight Football Club does not guarantee any amount of playing time, positions within a team lineup, leadership roles, or duties. This agreement only offers acceptance into the team, and any game time will be up to the coach’s discretion. I understand and agree that money being paid to participate on the team for the next season constitutes a commitment to Windermere Soccer Club and Sunlight Football Club as a whole and not one particular team. In rare events, it is not possible to allocate players to a team for unforeseen reasons, NO REFUND will be issued for any payments made. I understand and agree that the list of what is INCLUDED and NOT INCLUDED in my club dues can be found in this agreement and can be requested via email at: contact@windermersoccerclub.com. I understand and agree that the list of competitions is tentative and if competition is removed or changed from the program NO REFUND OR CREDIT will be issued. This Agreement will remain in full effect. I understand and agree that in the event that the program, for any reason, becomes unavailable or ends its activities, NO REFUND and NO LIABILITY of any type will be paid by either party. I understand and agree that a check for the amount agreed upon between myself and the club must be paid before I am able to participate in club activities. By checking the box above, I acknowledge that I have read this entire document, that I understand and agree to its terms and provisions, and that I have agreed to them voluntarily and without coercion.

I understand and agree that the list provided here is just a set of important rules and the total set of current Rules. I understand and agree that the club practices schedule follows the club calendar, and if a practice needs to be canceled due to provider vacations, holidays, facility closure, field or facility unavailability, weather conditions, or any other reason that prevents the practice or a game from happening on the scheduled date/time, no refund, credits, discount, makeup practices, or rain checks will be provided. I understand and agree that Windermere Soccer Club and Sunlight Football Club reserve the right to change the day, time, or location for one or all practices or games/tournaments. These changes will be informed to the player via email, phone, SMS, communications app, or post on our Social Media. I understand and agree that if I need to contact one of the coaches, directors, or club's staff, this contact can NEVER be made during a practice or a game/tournament and never in front of any kid/player or another parent. In the case of a necessity of speaking to a Coach or Club Director, a meeting must be requested and scheduled, and ALL the issues must be discussed in a scheduled meeting or via email if preferred. Posting in a public post on social media or group chat is strictly prohibited. If this rule is not followed, the player will be removed from the club, and no refund will be issued. A penalty of US$1,000 (One Thousand Dollars) will be issued, and the club will seek compensation for damages at the player's expense, including but not limited to attorney fees, court fees, and all related expenses. A meeting can be requested at any time via email: office@windermeresportsclub.com or info@sunlightfc.us. I understand and agree that as a player, I must commit to appropriate sportsmanship conduct at all times, either at practice or at events, with respect to coaches, team players, referees, event organizers, and other teams' players and fans. If this rule is not followed, the player will be removed from the club, and no refund will be issued. A penalty of US$1,000 (One Thousand Dollars) will be issued, and the club will seek compensation for damages at the player's expense, including but not limited to attorney fees, court fees, and all related expenses. I understand and agree that there is NO GUARANTEE of playing time, and the starting line-up, positions, and playing time will be decided based on the best interest of the team. I understand and agree that the development of each athlete's ability to play and participate in sports is not the same; for that reason, it is not possible for the club to guarantee results for any player. I confirm that I have read and understood all CLUB RULES & CODE OF CONDUCT and agree to abide by all of them with no exceptions. I understand and agree to a non-competition clause for the period of five years to not open a similar business in the state of Florida without the written consent of Windermere Soccer Club or Sunlight Football Club. I understand and agree that as a player, I am responsible for completing a SafeSport course and an AAU course, both of which are done online. The club will provide the necessary information for these courses, and completion of both courses is mandatory for participation in any club activities. Failure to complete the required courses may result in suspension or termination from the club, and no refunds will be issued.
